Acted
on behalf of client and supervised international litigation strategy
with associate counsel throughout Asia, Australia and the EU.
Corresponding rights enforcement and infringing goods seizures were
against a former distributor who had ceased purchasing merchandise
and/or paying royalties and began manufacturing and distributing
knock-off products without consent. Matters were further complicated by
the British based owners failure to diligently prosecute its trademark
applications in the various countries. Using the common law based
strategy of world renowned mark through Queen's Counsels in London,
Melbourne and Hong Kong, was successful in reclaiming client's rights
by showing through advertisements, media coverage and the like, the
true ownership of the marks. These efforts resulted in royalty and
distributorship agreements and the granting of trademark registrations
in favor of client. Used U.S. and foreign Customs laws to effectuate
seizures of infringing goods upon importation into various countries.
Successfully defended Trademark, Trade
Dress, Copyright and Unfair Competition action involving international
watch designs. In US Federal Court, defeated Preliminary Injunction and
was successful in having the Complaint dismissed. Successfully
Cross-Complained against Plaintiff under business tort theories
obtaining compensatory and treble damages, along with an award for
attorney fees and costs from Plaintiff/Cross-Defendant.
Represented
interests of client, a large multi-national bank, in successfully
negotiating a settlement in an $11.5 mil international loan repayment
matter before the New York Supreme Court. The matter was fully handled
in approximately 90 days without need for further litigation.
Responsible
for incorporation and general business structure, securing intellectual
property rights, negotiation and implementation of business strategies
to create international seafood and produce broker and wholesaler in
Las Vegas. Responsible for negotiations with Senior Mexican officials,
the Maryland Seafood Authority and New York's Fulton Fish Market for
wholesale sales and with suppliers throughout South and Central America
and Southeast Asia.
Negotiated and obtained for client
exclusive Russian and CIS distribution rights for importation and
distribution of major HVAC supplier's goods from China and the United
States. Assisted client in obtaining appropriate Russian product
certification and other necessary documentation to begin business
operations.
Assisted client, a major Russian importer
of used cars to the EU, Russia and the CIS, with cross-border
transactional documentation and contracts for every aspect of
importation business, including purchase and international shipping
contracts. Also assisted client with US Customs issues.
Outside counsel for large Russian computer
corporation for matters involving contract drafting, letters of intent
and intellectual property prosecution matters. Filed, and prosecuted
and obtained various US and EU trademark applications in various
trademark classes for the client.
Represented various recording artists in
contract negotiations with Sony, BMI, Capital and Universal Records,
represented screenwriter in litigation involving profits and credits
for the film "Toy Soldiers" with Sean Penn, counseled many emerging
artists on various legal matters and careers.
